Terms of Service
These Terms of Service (“Terms”) are a contract between you and Arshad (“we”, “us”) governing your use of the NearBlend app (the “App”). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility and age
- You must be at least 13 years old to use the App.
- If you are 13–17, you may use the App only with the consent and supervision of a parent or guardian, who agrees to these Terms on your behalf.
- You confirm the information you provide, including your date of birth, is accurate.
2. Your account
- Keep your login credentials secure; you are responsible for activity on your account.
- Provide accurate information and keep it up to date.
- You may delete your account at any time from within the App.
3. The service
NearBlend helps you discover and chat with people and activities near you. To do this it shows your approximate location — coarsened to roughly 500 metres — to other users while you are sharing. You control sharing through permissions and Ghost Mode.
4. Safety — please read
Meeting people you don't know carries real-world risk. You are solely responsible for your interactions with other users. We do not verify the identity, background or conduct of users.
To stay safe:
- Never share your exact address, financial details or sensitive personal information.
- Be cautious about meeting in person. If you do, meet in a public place and tell someone you trust.
- Use Block and Report if someone makes you uncomfortable.
- Contact local emergency services if you feel unsafe.
We provide tools — approximate location, Ghost Mode, blocking, reporting — but cannot guarantee anyone's safety.
5. Acceptable use
You agree not to:
- Harass, threaten, stalk, bully, defame or harm others.
- Post or send content that is illegal, hateful, sexually explicit involving minors, violent or otherwise objectionable.
- Impersonate anyone or create fake profiles.
- Spam, scam, solicit or advertise without permission.
- Attempt to determine another user's precise location, de-anonymise users, or circumvent the App's privacy and location protections.
- Probe, scrape, overload, reverse-engineer or interfere with the App or its security.
- Use the App for any unlawful purpose or in violation of these Terms.
6. User content
- You retain ownership of content you create, such as profile information and messages. You grant us a limited licence to host, transmit and display it in order to operate the App.
- You are responsible for your content and must have the rights to share it.
- We may remove content or restrict accounts that violate these Terms.
7. Reporting and enforcement
You can report users from within the App. We may review reports and take action including warning, restricting, suspending or terminating accounts, and may remove content, at our discretion, to protect users and the service.
8. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Some provisions survive termination, including sections 4–6 and 9–11.
9. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, secure or error-free, or that it will meet your requirements, and we are not responsible for the conduct of any user.
10. Limitation of liability
To the maximum extent permitted by law, Arshad and any affiliates will not be liable for indirect, incidental, special, consequential or punitive damages, or for any loss arising from your interactions with other users or your use of (or inability to use) the App. Where liability cannot be excluded, it is limited to the amount you paid us, if any, in the 12 months before the claim, or the minimum permitted by law.
11. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your content, your use of the App, or your violation of these Terms or of any law or third-party rights.
12. Changes to the App or Terms
We may modify the App or these Terms. For material changes to the Terms we will provide notice in the App. Continued use after changes take effect means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Disputes will be subject to the courts of India, unless applicable law provides otherwise.
